DMCA Policy
Weather Forecast ("we", "us", or "our") respects the intellectual property rights of others and is committed to complying with the Digital Millennium Copyright Act (DMCA). This policy outlines our procedures for addressing alleged copyright infringement and for submitting counter-notifications.
If you believe that content hosted on our platform infringes your copyright, please follow the instructions below to submit a DMCA Notice. If you believe your content was removed in error, you may submit a Counter-Notification.
Filing a DMCA Notice
To file a DMCA notice of claimed infringement, you must provide a written communication that includes substantially the following:
- Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the infringing material: A description of where the material that you claim is infringing is located on the Weather Forecast platform, sufficient to permit us to locate the material (e.g., specific URLs).
- Contact information of the complaining party: Your name, address, telephone number, and email address.
- Statement of good faith belief: A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
- Statement under penalty of perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Electronic or physical signature: Your electronic or physical signature (e.g., by typing your full legal name).
Counter-Notification Process
If you believe that material you posted on Weather Forecast was removed or access to it was disabled by mistake or misidentification, you may submit a counter-notification to us. Your counter-notification must include substantially the following:
- Identification of the material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., specific URLs).
- Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Subscriber's name, address, and telephone number.
- Statement of consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Weather Forecast may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Electronic or physical signature: Your electronic or physical signature (e.g., by typing your full legal name).
